Acceptable Use Policy
This Acceptable Use Policy (“AUP”) governs the Merchant’s use of the Services, the Shalem Platform, and any content uploaded or created through the Service. Defined terms herein shall have the same meaning as defined in the Platform Agreement [add link to the Platform Agreement], the Acceptable Use Policy is an integral part of the Agreement and is a legally binding policy.
This Acceptable Use Policy is subject to change at any time without notice, and the changes will be effective when posted.
- Purpose
The purpose of this AUP is to ensure the use of the Platform is in compliance with applicable laws and card or payment rules and policies, specify governing the Retails goods and services sold and type of activities/business as well as the transactions conducted through the Platform.
- Prohibited Users
Buyer, Retailer and Seller, using the Platform certifies the following: You are not identified as a sponsor of international terrorism, listed on any relevant sanctions list including but not limited to the U.S. Department of State’s Terrorist Exclusion List, Office of Foreign Assets Control’s Specially Designated Nationals and Blocked Persons List, or any list produced by the U.S. Department of Treasury.
- General
You will ensure that the Services and the Shalem Platform is used in a good, lawful and ethical manner, therefore using the Services and the Shalem Platform for the following activities is strictly prohibited:
- Adult Services including pornography, nudity, sexual acts, sexual services, or content otherwise meant to arouse sexual excitement.
- Gambling including Games of skill where participants receive cash or cash-equivalent prizes
- Drugs or drug proprietors selling illegal substances including drug paraphernalia and Marijuana related products and businesses
- Financial or other regulated products services and securities such as Credit repair services, virtual currencies, pyramid or Ponzi schemes, shell banks and companies
- Counterfeit items
- Human remains and body parts
- Childe exploitation
- Human trafficking and mail order bride services
- Hazardous materials and pyrotechnic devices
- Products or services related to religious, political or social campaigning
- Unauthorized Access
You may not attempt to gain unauthorized access to, or attempt to interfere with or compromise the normal functioning, operation, or security of any portion of the Services and the Shalem Platform. You may not use the Services and Shalem Platform to engage in any activities that may interfere with the ability of others to access or use the Services, Shalem Platform or the Internet. You may not use the Services and the Shalem Platform in order to distribute malware, virus software, root kits, password crackers, spyware, adware, keystroke capture programs and other programs that are normally used for malicious activity. A Merchant is strictly prohibited from attempting to gain access to the user accounts of other Merchants, or violating system or network security, each of which may result in criminal and civil liability.
- Intellectual Property Rights
Do not infringe intellectual property rights in any manner and respect other individuals’ work.
- Complaints and Appeals
We may, stop your use of the Service, suspended your account or terminate the Agreement, if we find it to be in breach of the AUP, card network rules or applicable law.
You may appeal or contest our decision to remove content or disable, block or suspend your account by contacting us through ___________. Please include your reasoning as to why you feel our decision was incorrect. If we feel that our decision was in fact incorrect, we will notify you of such and rectify the situation by putting the content back, reactivating your account or the Services for you (as applicable) and removing any strikes or restrictions so that this will not be held against you in the future
